Licensed medical professionals provide critical medical care to patients that is consistent with the standards of professional conduct. State licensing boards govern the issuance of medical-related professional licenses and ensure licensees comply with their occupation's rules of conduct. Across the country, licensed medical professionals are prohibited from using illegal drugs and from misusing alcohol and other controlled substances. No one wants a doctor, dentist, nurse, or physician assistant to care for patients while under the influence of drugs or alcohol.
Importantly, the rules of professional conduct often govern a licensee's conduct while providing direct patient care, as well as their behavior at home and outside the office, hospital, or clinic. A fun night out with friends or a celebratory party with loved ones can have devastating repercussions if an individual's off-duty indulgence in alcohol or drugs becomes the basis of a disciplinary complaint and investigation.
Allegations of professional misconduct, including those involving medical professionals and the use of drugs or alcohol, can quickly become destructive. Any license holder accused of professional misconduct must take immediate action to defend themselves, their license, their reputation, and their livelihood.
If you are facing misconduct accusations or a disciplinary investigation because of your off-duty use of alcohol or drugs, the Lento Law Firm can help. Texas Physician Assistant Suspended for Unprofessional Behavior and Improper Use of Drugs or Alcohol
It has been reported that the Texas Medical Board (TMB) temporarily suspended the license of David Anthony Ward, a physician assistant in East Texas. The TMB based the disciplinary sanction on its conclusion that Ward had behaved unprofessionally or dishonorably, regularly used drugs or alcohol, and suffered from an unmanaged and unmonitored impairment.
Ward's license suspension is an important reminder that any allegation of professional misconduct should be taken seriously. Every licensed medical professional should know that their behavior, outside the office and off the clock, can lead to a complaint, investigation, or sanction that may restrict their ability to work and earn a living.
