Nurses Surrendering Licenses Under Operation Nightingale: Beware the OIG Exclusion List

Posted by Joseph D. Lento | Nov 15, 2023 | 0 Comments

If you are a nurse who has surrendered or is considering surrendering your nursing license related to the FBI's Operation Nightingale against several now-closed Florida nursing schools, you need to be aware of the federal OIG Exclusion List. If your name appears on that list because of your license surrender, you may not be able to work in any federally funded nursing employment, even employment for which you would otherwise qualify without the license that you surrendered.

Retain the Lento Law Firm's premier Professional License Defense Team now to advise and represent you with respect to your license surrender, the OIG exclusion list, and your ability to continue your nursing career and work. Call 888.535.3686 or complete this contact form now. Time is of the essence.

OIG Notices Regarding its Exclusion List

The Office of the Inspector General (OIG) of the U.S. Department of Health and Human Services is notifying affected nurses that it maintains an OIG Exclusion List. The OIG is telling nurses who surrender their license under the FBI's Operation Nightingale enforcement action against the now-closed Florida nursing schools, that the OIG is putting those nurses on its OIG Exclusion List.

The Impact of an OIG Exclusion Listing

The OIG notices to nurses surrendering their license under Operation Nightingale tell the nurses that the OIG intends to use its Exclusion List to disqualify payment for their nursing or other services under any federal healthcare funding program. Those programs include Medicare, Medicaid, and TRICARE.

Nurses on the OIG Exclusion List must either contest the OIG's listing of their name on its Exclusion List within thirty days or notify their employer of their inability to receive payment for services. In other words, if you do not timely and effectively dispute the OIG's notice, you may not be able to work again for an indefinite time in any position providing any services paid for by federal healthcare funding.

How Professional License Defense Can Help

Fortunately, you are not without help or hope. You may have one or more avenues through which you can preserve your ability to earn a living in the healthcare field, even under federally funded employment. And our Professional License Defense Team has the skills and experience to help you pursue those avenues for the best possible outcome.

Depending on your circumstances, your best move may be to prove that you earned your nursing education despite the closure of your Florida nursing school under Operation Nightingale. You may be able to retain your nursing license despite your attendance at one of the now-closed schools.

If not, you may still be able to successfully dispute your inclusion on the OIG Exclusion List by taking the appeal that the OIG offers. You may have the education, skill, and experience to continue in the nursing field, independent of your Florida nursing school attendance.
