OBGYN Faces New Jersey Practice Ban
The New Jersey State Board of Medical Examiners temporarily suspended the license of a Mercer County OBGYN accused of sexually exploiting two patients during medical exams. Dr. Bruce Pierce, a practitioner at Delaware Valley OBGYN & Princeton Midwifery in Lawrenceville, allegedly engaged in gross negligence and professional misconduct by inappropriately touching two women during separate visits in 2023. In a complaint to the New Jersey Office of the Attorney General, Pierce allegedly dismissed a chaperone during an exam with one patient and later called another patient to apologize for his behavior.
In addition to presenting text message evidence of his "consciousness of guilt," the board deemed the complaint against Pierce "credible, chilling, and compelling." Following a November 13 hearing, the state authority determined the OBGYN's continued practice posed a "clear and imminent danger to public safety," and the suspension will remain in place pending further proceedings with the Office of Administrative Law.
Defending Against Complaints and Licensing Boards
Mere allegations that an OBGYN has sexually exploited a patient can immediately disrupt professional standing and patient trust and provoke stringent board actions like suspensions. Although the board gives the accused the opportunity to defend themselves, it requires an immense amount of focus and knowledge of the administrative procedures governmental departments use to adjudicate violations.
OBGYNs need the assistance of an experienced attorney with the Lento Law Firm to thoroughly review the allegations and ensure that the board isn't overstepping its authority to institute temporary disciplinary measures. By collecting pertinent evidence and assembling a robust defense strategy, an attorney can provide significantly stronger influence on the outcome of any disciplinary proceedings than the OBGYN would have alone. Additionally, they can offer insight into negotiation strategies with licensing boards in order to mitigate career-threatening sanctions, such as license suspension or revocation.
