New Jersey Attorney General's Prior Order
New Jersey's attorney general had previously issued an order rescinding the licenses of nurses whom FBI Operation Nightingale investigators alleged had purchased fraudulent educational credentials. The attorney general's order demanded that those nurses prove their credentials legitimate or relinquish their nursing license. The orders involved a relatively small number of nurses whose names appeared on the FBI list.
New Jersey Board of Nursing Expands Investigation
New Jersey's Board of Nursing now appears to have greatly expanded the investigations to include nurses with any connection with the suspect Florida nursing schools. You may have received or may be receiving this New Jersey Board of Nursing demand, even if your name was not on the FBI's list as having received false credentials:
Enclosed is a Demand for Statement Under Oath in Writing prepared by the New Jersey Board of Nursing (“Board”). The Board has received information that you have been named or have had some affiliated [sic] with programs in which the owners now have been indicted for issuing fraudulent nursing degrees, diplomas, and transcripts obtained from accredited Florida-based nursing schools.
The New Jersey Board of Nursing's Documentation Demand
The expanded New Jersey Board of Nursing investigations demand that nurses with any connection to the suspect Florida schools provide pages and pages of detailed, typewritten answers and documentation, while attesting under oath to the accuracy of the information. The Board demands transcripts and other records from the now-closed schools, airline tickets to and from the schools, and similar evidence, while threatening to revoke the license of any nurse who does not timely respond:
Please provide answers to the enclosed questions, and submit your certified written answers within thirty (30) business days of your receipt of this notice. As an applicant or licensee to the Board, you are required to respond to this request pursuant to N.J.S.A. 45:1-21(e) and N.J.A.C. 13:45(c)-1.3. Failure to timely respond to this request may result in disciplinary action, suspension, denial or revocation of your license.
