Medical License Suspension in Wyoming: What to Expect

On February 15, 2024, the Wyoming Board of Medicine (WYBOM) took the serious step of suspending the license of Physician's Assistant Jason Ray, pending a hearing on the matter. This action follows a complaint filed against Ray on January 31, alleging that he engaged in sexual misconduct with a patient and possibly staff members while employed at Sublette County Hospital District. After a preliminary review, the WYBOM suspended Ray's license because “public health, safety, and welfare imperatively require emergency action in this matter.” The complaint is not Ray's first legal issue–he previously pleaded guilty to battery resulting in bodily injury of a minor in August 2022. The Disciplinary Process for Wyoming Medical Professionals

Wyoming requires an individual with a complaint against a medical professional to file it in writing with the WYMOB. No anonymous complaints are accepted. Once the Board receives the complaint, staff members review it to ensure that the WYMOB has jurisdiction over the issue and that if the allegation were true, it would constitute a violation of the Medical Practice Act.

If the complaint meets these two criteria, the staff will notify the medical professional in question and request a response, as well as all documents and records relevant to the matter. After receiving the response and pertinent documents, Board officers will conduct an initial review of the matter to decide how to proceed with the complaint. They can dismiss the complaint outright, request the staff to obtain further information before making a final determination, or appoint members of the Board, referred to as Interviewers, to investigate the complaint in greater detail.

The Interviewers will review the materials provided in-depth and may conduct informal interviews with the individuals involved. Once the investigation is complete, they may recommend closing the complaint against the professional, reaching an informal agreement with the professional to engage in specific actions, such as taking continuing medical education classes or resolving the matter by formal Consent Decree. The Interviewers may also decide to issue a formal complaint and petition detailing the allegations. The matter would then go before a hearing panel composed of the full WYMOB. The medical professional has the opportunity to present their case at the hearing.

Under Wyoming law Section 33-26-402, the WYMOB has the authority to suspend, revoke, refuse to issue or renew a medical license, or impose other disciplinary actions against a medical professional if the individual has violated any of the 35 grounds defined in that section. If the Board finds in the hearing that the medical professional has violated one or more of these grounds, they will issue the appropriate disciplinary action.
