Investigations Trigger Childcare License Suspensions

Posted by Joseph D. Lento | Jun 11, 2025 | 0 Comments

You've built your childcare business on trust with local families. As rewarding as it is, though, you know that running your childcare service comes with risks. One of those risks is that someone will accuse your business of wrongdoing and your state licensing board will suspend your license while it investigates. Even if the board ultimately finds the accusations against you were false, your license will have been suspended for the entire period of the investigation.

For example, Sunshine's Playhouse and Preschool in Georgia and a home-based childcare provider in Lyle, Minnesota, were shut down as soon as investigations of wrongdoing were opened against them. While the investigations regarding the two childcare providers are not related, they share in common a real risk that childcare providers across the country must contend with: the loss of revenue, reputation, and even their businesses during an investigation.

If you're a childcare provider facing an investigation and the loss of your license, you need the Lento Law Firm on your side. What Went Wrong?

On December 20, Sunshine's Playhouse and Preschool in Alpharetta, Georgia, experienced their worst nightmare. A small boy choked on a mango and died five days later. At the outset of the ensuing investigation, Sunshine's Playhouse and Preschool was ordered to temporarily shut down. Ultimately, Sunshine Playhouse and Preschool lost its license permanently.

In a separate incident, on January 17, an allegation of serious abuse that allegedly occurred at Amanda Frank's home-based childcare business prompted Mower County, Minnesota, to open an investigation. At the opening of that investigation, Amanda Frank's childcare license was suspended; just like that, Amanda's livelihood was in jeopardy.

How Investigations Impact Your Childcare License

As a childcare provider, you're used to the bumps and scrapes children get from playing. But you're always operating with the chance that a more serious injury could occur, or an accusation could derail the business you've built. If a parent lodges a complaint or a child's injury requires medical intervention, there's a likelihood that your daycare or preschool could come under investigation by your state's agency.

Being under investigation is a scary, stressful time for any childcare provider. Knowing your rights is the first step toward a favorable outcome. Generally speaking, you have the right to know the accusations against you. You also have the right to explain your side and provide evidence to support your claims.

In some cases, state agencies will suspend a daycare provider's license and order the facility to temporarily shut down while the investigation is ongoing. The damage to your reputation can be difficult to heal.
