Home Daycare Professional License Suspended for Unsanitary Conditions

Posted by Joseph D. Lento | Apr 01, 2024 | 0 Comments

All states have specific licensing requirements for individuals and businesses looking to operate daycare centers, whether in their homes or another venue. When businesses or individuals with these licenses are accused of violating the license in some way, the state reviews the issue and determines whether the professional license should be suspended, revoked, or limited in some other way.

If you hold a daycare license or an early childcare license and are accused of violating it in some way, you need a strong defense. Any disciplinary action against your license can have disastrous consequences for every area of your life. Call Lento Law Firm today at 888-535-3686 or schedule a consultation online for help.

License Suspensions Can Cost You

In January of 2024, a group day care home in Derby, Kansas, had its license suspended by the Kansas Department of Health and Environment (KDHE). The owner of TNT Childcare, Tiffany Thompson, was issued a license in March of 2023 to operate a group daycare home. After being notified of possible health and safety violations, the KDHE tried to contact Thompson through calls and text messages but was unsuccessful. An agent was dispatched to the daycare twice to attempt to enter the facility, but Thompson refused them access.

When KDHE was finally able to enter the facility, they found several health and safety violations, including waste in a potty chair that had not been removed, diapering and changing procedures not being followed, improper handling and storage of food, animal feces in the outdoor play area, changing areas not being waterproofed, and employees failing to wash their hands after helping a child with the toilet or changing their diapers.

The report also stated that the facility was dirty and disorganized, and it had vermin and other objects and materials that were dangerous to children. To ensure the facility was cleaned and fully compliant with the KDHE, the daycare license was suspended, and Thompson was instructed to contact all of the children's parents. Moreover, all home volunteers, employees, and residents must have a background check before the daycare license can be reinstated.

How Lento Law Firm Can Help

In the case above, the licensed professional was accused of violating the standards of her daycare operation license and, upon a full investigation, had her license suspended until she became fully compliant. Until then, she is not allowed to operate her daycare facility and must forfeit any income she would have made from it, which can seriously impact her livelihood.

When individuals are found responsible for violating their professional licenses' standards, it not only impacts their ability to work on a daily basis, but it can prevent them from getting a new job, working in a certain field, or even being around family and friends until they get back to compliance. If you or someone you know has been accused of a professional license violation, they must immediately reach out to an experienced professional license defense attorney.

The Lento Law Firm Professional License Defense Team has spent years helping individuals defend their professional license and their reputation and livelihood.
