Georgia Supreme Court Strikes Down Unreasonable Law Regulating Lactation Consultant Licenses

Posted by Joseph D. Lento | Sep 02, 2023 | 0 Comments

License regulation laws are meant to protect patients and prevent harm, but sometimes they are so burdensome they end up preventing competent healthcare professionals from providing care. The Georgia Supreme Court recently struck down one such law, The Georgia Lactation Consultant Practice Act.

The act required lactation providers to obtain a license from the Office of the Georgia Secretary of State, to practice, and only consultants who had obtained certification from the International Board of Lactation Consultant Examiners could get this license.

IBCLCs (International Board Certified Lactation Consultants) have to complete the equivalent of two years of college courses, undertake 300 hours of supervised clinical work, and take a $700 exam. CLCs (Certified Lactation Consultants) are required to complete a 52-hour course, demonstrate competence in various areas and pass a $120 exam.

Since the act was struck down, CLCs can now practice without having to obtain IBCLC certification.

License Suspension Or Revocation

Licensing boards can sometimes act as gatekeepers rather than working to prevent harm. This affects many professionals – especially healthcare professionals – and prevents them from providing care. If you find your licensing board is putting unnecessary obstacles in your way and making it difficult to obtain, retain or renew a license, consider reaching out to the Professional License Defense Team at the Lento Law Firm.

The Lento Law Firm team of experienced attorneys can help you put together a strong case and also negotiate with licensing boards on your behalf, ensuring you aren't needlessly hassled due to a license-related issue.

Licensing boards often have long and complicated requirements for doctors, nurses, midwives, and other healthcare professionals to fulfill, and sometimes this can prevent genuinely competent and experienced professionals from practicing. Moreover, it also impacts patients who may have to find alternative care if their medical professional's license is temporarily or permanently revoked.
