License regulation laws are meant to protect patients and prevent harm, but sometimes they are so burdensome they end up preventing competent healthcare professionals from providing care. The Georgia Supreme Court recently struck down one such law, The Georgia Lactation Consultant Practice Act.
The act required lactation providers to obtain a license from the Office of the Georgia Secretary of State, to practice, and only consultants who had obtained certification from the International Board of Lactation Consultant Examiners could get this license.
IBCLCs (International Board Certified Lactation Consultants) have to complete the equivalent of two years of college courses, undertake 300 hours of supervised clinical work, and take a $700 exam. CLCs (Certified Lactation Consultants) are required to complete a 52-hour course, demonstrate competence in various areas and pass a $120 exam.
Since the act was struck down, CLCs can now practice without having to obtain IBCLC certification.
