In January 2023, the Medical Licensing Board of Indiana revoked Dr. James Jenison's professional license after various women claimed he touched them inappropriately during examinations. However, he recently had his license reinstated following a successful appeal to the Marion County Superior Court. This case is an example of why, at the Lento Law Firm, we fight for our clients even when the odds seem stacked against them.

The Claims Against Dr. Jenison
The accusations against Dr. Jenison date from 2019, when two women claimed that he groped and fondled them during medical examinations. Dr. Jenison denied the allegations, but the Board suspended his license pending internal investigations and ultimately offered him voluntary resignation, which he accepted. However, when the Board later revoked his license permanently, he appealed the decision on the grounds that it was disproportionate and unsubstantiated, and he continued to profess his innocence.
The Judge's Decision
In May, a Marion Superior Court Judge ordered the reinstatement of Dr. Jenison's license on two main grounds:
- The Board did not present any substantial evidence to support its decision to revoke Dr. Jenison's license.
- There is no proof that Dr. Jenison intended to touch the women in a sexual, lewd, or otherwise inappropriate way.
Unsurprisingly, Dr. Jenison was never charged with any sex-related crime following these alleged incidents. The judge agreed with Dr. Jenison's claims that, despite how the women may have interpreted the contact, he never intended any wrongdoing.
The Danger of Unfounded Accusations
It's every doctor's worst nightmare for a patient to misinterpret physical contact during an examination. The very nature of intimate exams makes them especially challenging for even the most experienced doctor to navigate, as they try to strike a balance between examining a patient carefully, and refraining from any action which could be misinterpreted.
Even if only one patient feels uncomfortable, despite your professional intentions, you could face a flurry of questions – and even a formal investigation. When examining patients, you might reduce the risk of misunderstandings by:
- Having another health professional or chaperone present
- Explain exactly what you are going to do, and why
- Remind the patient that they can stop the exam at any time
