Doctor Could Be Disciplined After Blaming COVID Vaccine For Patient’s Death

Posted by Joseph D. Lento | Jan 04, 2025 | 0 Comments

A physician in California is under investigation by the state medical board for several infractions, including record-keeping violations and gross negligence. One of the most serious gross negligence violations is alleging that Dr. Tam Ky Nguyen blamed the COVID-19 vaccine for the death of a stroke patient without medical evidence. Dr. Nguyen faces severe sanctions against his medical license if the California Medical Board investigation finds evidence substantiating any of the infractions.

Are you a doctor facing board discipline for a controversial diagnosis? Being charged with misconduct because of a miscommunication or disagreement between you and a patient, a member of a patient's family, or even medical staff may seem like a nightmare but the consequences are very real. However, you have the right to a defense and due process. Call the Lento Law Firm Professional License Defense Team at 888-535-3686 or contact us online today.

Doctor Allegedly Misidentified Cause of Death for COVID-19 Patient

The original complaint against Dr. Nguyen originated with the Fountain Valley Regional Hospital, which informed the board that Nguyen had committed multiple potential violations. Dr. Nguyen failed to participate in a mandatory “psychiatric evaluation” and violated the hospital's protocols for admitting COVID-19 patients. The doctor is also accused of sending “concerning information about COVID-19 and COVID vaccinations” to Fountain Valley Regional Hospital's executive committee.

A subsequent investigation that included a thorough review of Dr. Nguyen's patient records and interviews with co-workers also revealed three instances where the Doctor's methods constituted “extreme departures from the standard of care.” In one case, Dr. Nguyen had a 58-year-old patient suffering from high blood pressure, diabetes, and a thyroid condition.

After the patient died of a stroke, Dr. Nguyen classified their death as a negative reaction to Moderna's COVID-19 vaccine. According to the complaint, Dr. Nguyen reached this conclusion “without any evidence or objective information.” Since the Board alleges he Doctor reached this conclusion without evidence and then put it on an official medical record, they are charging this as a record keeping violation.

Alleged Violations in Patient Care and Treatment

The Board investigation uncovered an additional incident where Dr. Nguyen advised a “high-risk” patient who had been admitted to the hospital with what appeared to be COVID-19 complications to avoid COVID-19 boosters and instead prescribed them high levels of ivermectin and hydroxychloroquine.

Eventually, an infectious disease specialist at the hospital advised the patient to stop taking these medications. The final misconduct allegation accuses Dr. Nguyen of diagnosing a patient suffering from high blood pressure, diabetes, and flu-like symptoms as having a “possible adverse reaction to a COVID-19 vaccine.” Dr. Nguyen also advised the patient to stay away from the vaccines.

Dr. Nguyen Faces Severe Penalties

Record-keeping violations and gross negligence are serious charges. Dr. Nguyen faces the suspension, revocation, or possible placement of his medical license on probationary status if the Board finds the doctor committed misconduct in any of the charged violations. In cases this serious, the quality of Dr. Nguyen's license defense team will have a massive impact on the outcome.
