Child Tests Positive for Meth: What Happens When Your Daycare License is at Risk?

June 7, 2025

A recent case in South St. Paul, Minnesota, has shocked many child care professionals: a 3-year-old child tested positive for methamphetamine after attending daycare at a facility run by local city councilor Pam Bakken.

The Minnesota Department of Human Services responded by suspending Bakken’s daycare license, creating immediate consequences for her career and livelihood. This disturbing incident highlights how quickly a child care provider’s license can come under threat, even in situations where the full circumstances remain unclear.

What Happened in the South St. Paul Case

According to reports, the child was picked up from Bakken’s daycare on December 6, 2024, showing unusual behavior including vomiting. The child’s mother later reported that her son mentioned eating “onion crumbs” in the daycare bathroom.

After being taken to Children’s Minnesota Hospital, toxicology tests confirmed methamphetamine ingestion. While police did not find drugs during their search of the facility, the Minnesota DHS still ordered an immediate suspension of Bakken’s license on March 4, 2025.

The agency cited several serious violations:

  • Failure to prevent children from accessing toxic substances
  • Incomplete background check for a household member
  • Allowing a person who was subject to a disqualification variance to be alone with children
  • Incomplete enrollment documentation for children

Dakota County also found Bakken responsible for maltreatment of a minor by neglect—a finding that carries significant professional consequences.

How Methamphetamine Could Enter a Child Care Setting

Even conscientious providers can find themselves facing allegations of drug exposure at their facilities. Methamphetamine could enter a daycare through several potential channels.

Environmental contamination might occur on surfaces, toys, or furniture if someone in the household uses or manufactures methamphetamine. Improper storage of harmful substances in containers accessible to children presents another risk.

Visitors or household members might bring substances onto the premises without the provider’s knowledge. Brief lapses in supervision could allow children to access hidden or discarded items. The Minnesota case raises important questions about responsibility. Regardless of how the substance entered the facility, child care providers are held accountable for maintaining safe environments at all times.

Minnesota’s Disciplinary Process for Child Care Licenses

When a serious violation occurs in Minnesota, the consequences can be swift and severe. A Temporary Immediate Suspension (TIS) requires immediate cessation of operations. Providers can appeal but must remain closed during the process. DHS must decide on final action (revocation, conditional license, etc.) within 90 days.

Additional penalties may include fines, mandatory training, or permanent license revocation. The standards for child care providers in Minnesota are understandably strict. The state expects providers to maintain constant supervision, secure all toxic substances, and conduct background checks on all adults with access to children.

Providers must also follow all terms of their licenses without exception, which includes maintaining proper documentation and honoring any special conditions attached to their license.
