Psychiatrist Regulatory Bodies in Hampton Roads
While Virginia Beach might be the most well-known place in Hampton Roads, it comprises a lot more than Virginia Beach itself. Hampton Roads also includes Norfolk and Chesapeake, Virginia, as well as Elizabeth City and Kill Devil Hills, North Carolina. Because Hampton Roads falls in two states, where you work within Hampton Roads will determine which regulatory body will handle misconduct allegations against you.
If you are located on the Virginia side of Hampton Roads, the Virginia Board of Medicine is your regulatory body for licensing, continued learning education, and more. When you are facing disciplinary action against your Virginia-issued psychiatrist license, you will be hearing from the Virginia Board of Medicine, along with the Virginia Department of Health Professions Enforcement Division. If you are a North Carolina-based psychiatrist, your license is regulated by the North Carolina Medical Board, which will also be charged with addressing your misconduct case.

The Disciplinary Action Process for Psychiatrist Misconduct in Hampton Roads
The North Carolina Medical Board and the Virginia Board of Medicine each have their own specific rules and procedures for handling disciplinary action. Meaning a Virginia psychiatrist facing disciplinary action and a North Carolina psychiatrist accused of misconduct won’t go through an identical process. Even the terminology used by each authority can be different. Your LLF National Law Firm attorney is familiar with both Virginia and North Carolina procedures and can walk you through the applicable process.
While the processes differ, if you’re being accused of misconduct in Hampton Roads, you can expect the process to follow this trajectory.
Complaints
Complaints will be directed to either the North Carolina Medical Board or the Virginia Department of Health Enforcement Division (Enforcement Division). During a preliminary review of the complaint, staff will determine whether it violates any applicable laws or regulations. If not, the case will be closed.
Investigation
The Enforcement Division or the North Carolina Medical Board will investigate any credible complaints. The investigation will involve collecting any relevant documentation and evidence for your case. It will also involve interviewing you, witnesses or patients involved, your employer, and any other relevant party. As soon as you hear there is a complaint against you, call the LLF National Law Firm.
You should never be in the investigative phase without one of our Professional License Defense Team attorneys preparing you for every interaction with investigators. No matter how friendly an investigator is, remember, they work for the state and the public; they aren’t on your side. The only person who will give you the benefit of the doubt and put you first is your LLF National Law Firm attorney.
Temporary Suspension
In rare cases, your medical board will issue an immediate temporary suspension of your license if it believes you are a threat to patient health and safety. You have a right to appeal the temporary suspension. Contact your LLF National Law Firm attorney immediately to begin that process to mitigate damages to your patients and your practice.
Consent Agreements
Your LLF National Law Firm attorney will do everything in their power to get a settlement agreement that you feel comfortable with. The formal disciplinary action process can be lengthy and emotionally taxing. We work to get an outcome with the minimal, if any, disciplinary action against your license. We never agree to anything without your permission or anything you aren’t comfortable with.
Review and Initial Determinations
Your medical board will review your case. This can include calling you in for informal meetings, talking with your attorney, and more. The board will then issue its proposed determination. Determinations can include:
-
Issuing an Advisory letter
-
Reprimand
-
License probation
-
License suspension
-
License revocation
-
Monetary penalties
If you agree with and are willing to accept the proposed action, or have come to a consent agreement, your case will end here.
Formal Hearing
If you do not accept the proposed action, you have the right to a formal administrative hearing. Formal hearings work similarly to a court trial. There are documents you need to file, evidentiary rules, and set procedures and deadlines you cannot stray from. If you make even the smallest mistake or miss a deadline, you could lose your case on a technicality.
You cannot afford to go into a formal hearing without legal assistance from our Professional License Defense Team. At the hearing, your LLF National Law Firm attorney will present your defense, including examining and cross-examining witnesses, presenting evidence, and making a closing statement.
Disciplinary Action and the Interstate Medical Licensure Compact and Ability to Practice in Other States
As you likely know, the Interstate Medical Licensure Compact (IMLC) allows psychiatrists to practice in other states outside of their licensing state. Each state must pass legislation to enter the IMLC. Virginia is not an ILMC member as of 2025, but more and more states join each year. North Carolina is an ILMC member. This means that if you have a Hampton Roads psychiatrist license in North Carolina, the North Carolina Medical Board will report you’re disciplinary action against your license to ILMC. ILMC then has the right to take its own disciplinary action, including revocation of your ILMC license.
If your ILMC license is revoked, or you’re a Virginia-licensed Hampton Roads psychiatrist with an action taken against your license, to practice elsewhere, you need to go through the application process in a new state. Your disciplinary action in Hampton Roads won’t stay in Hampton Roads – you won’t get an automatic fresh start elsewhere. All state medical boards will require you to disclose disciplinary action taken against your Hampton Roads psychiatrist license, and can ultimately prevent you from obtaining licensure elsewhere.
Appealing Disciplinary Action Against Your Hampton Roads Psychiatrist License
To say that you’re feeling discouraged after disciplinary action has been taken against your psychiatrist license would be an understatement. You may feel that all hope is lost and that you’re resigned to the fate your medical board has issued. But now isn’t the time to back down. There is a chance you may be eligible to file a disciplinary action appeal with your Hampton Roads medical board.
Not every case meets the requirements for an appeal. You may have looked up the requirements online and think you aren’t eligible, but don’t be so sure. Meeting with an LLF National Law Firm attorney to discuss your case will give you clarity on whether an appeal is appropriate in your case. The attorneys on our Professional License Defense Team know what appeals look like in reality. We know the language used in regulations on appeal eligibility is worded to discourage you from filing an appeal by making it seem like you aren’t eligible. Your LLF National Law Firm attorney will review your case and see if any blatant or hidden factors or errors make your case appropriate for appeal.
Windows for appeal are open for a short period — often just a few days — so you don’t have time to wait. Don’t risk waiving your right to an appeal; contact the LLF National Law Firm immediately. Our Professional License Defense Team frequently gets better outcomes for our Hampton Roads clients upon appeal. Even if you’ve been going through the disciplinary process alone, it isn’t too late to get the backing of our Professional License Defense Team.
