When AI Gets it Wrong
Some of the most blatant examples of overreliance on AI-generated content have come from the legal sector. A number of attorneys have been sanctioned by courts for submitting briefs that included made-up quotes and case citations that, it turns out, were generated by an AI tool and were not checked by the attorney whose name was on the brief.
- A career federal prosecutor in North Carolina recently resigned from his position after admitting that he had used AI to “catch up” on a draft that was filed with the court – and after the Magistrate Judge in the case found other errors in other cases that the same attorney had made.
- A federal appeals court sanctioned an attorney and fined her $2500 after it found 21 different “fabricated quotations or serious misrepresentations of law or fact” in a brief that she filed, and concluded that the attorney had used AI to draft much of a brief that she had filed but had then failed to verify the accuracy of the AI-generated content.
- A Florida attorney was suspended for one year by the Florida Bar’s Grievance Committee after it found “26 problematic case citations” in “four separate pleadings” that the attorney admitted may have been generated by AI.
These are just several of the many examples of licensed professionals using AI-generated content without verifying that the information was accurate. While these are all in the legal sector, it is not hard to imagine a situation where a medical professional uses an AI tool to help diagnose a patient, and fails to verify the AI tool’s conclusions before treating the patient based on that false information, harming the patient as a result. Or a professional engineer who relies on an AI tool’s incorrect evaluation of the strength of a particular part of a structure, and the structure eventually fails because of that mistake.
