Once probable cause is established, the board will either issue a citation or the case will move to mediation. If the citation is not disputed, the case is closed as is. The case will also be closed once the mediation has taken place. If the citation is disputed, then the Board will proceed with an investigation.

The investigation will determine if the conduct rises to the level of a violation of the law. If it does not, the complaint will be dismissed. There’s also the possibility that the Board is concerned about the conduct or competency of a licensee, but does not believe the conduct rises to the level of a violation, in which case it may issue an advisory letter. However, if there is evidence of a violation of the law, the Board may take action against the physician’s license, which can range from a reprimand for minor violations to assessing a fine, imposing terms, conditions, and/or restrictions, suspending the license, or even revoking a license.
