Utah Nurse Charged with Exploitation
A former Utah nurse, Kevin Charles Call, was recently charged with exploiting a vulnerable adult. Call's nursing license had been revoked earlier this year by Utah's licensing board due to misconduct charges he faced in Iowa. He was, however, caring for a man who prosecutors say is “low functioning mentally” and was accused by a family member of scamming the vulnerable man out of nearly $7,000. The charges against Call allege that he told the man that he was in legal trouble and that Call's brother, an attorney, could help if the man gave Call money.
Call was also charged with trespassing—according to prosecutors he entered the man's house at night without permission and confronted him about not taking his calls. He then apparently took the man's phone to try to have his number unblocked. Call has been charged with a second-degree felony for exploiting a vulnerable adult and a class A misdemeanor for trespassing.
Practicing without a License
One of the elements of this case is that Call was practicing as the man's registered nurse despite his license having been revoked. While his criminal case will move forward, and he could face penalties such as jail time and fines, he'll also have to deal with the Utah licensing board. The board's disciplinary procedures are entirely separate from the state's criminal justice system. While the licensing board can't throw Call in jail, it can take further action against his license (such as not re-instating it if he ever applies). It can also issue him a civil penalty and ultimately prevent him from working as a nurse in Utah.
