When President Josiah Bartlet of Aaron Sorkin’s iconic television drama “The West Wing” is contemplating whether to pressure a doctor to treat a gravely ill child of a controversial foreign leader, his wife – Doctor Abigail Bartlett – tells him “Doctors… aren’t allowed to choose patients on spec… doctors are liable in this country if they don’t treat the patient right in front of them.” This is generally true when patients are in need of necessary care. Yet, there are times when a physician’s consent to a request for care can land them in hot water professionally and/or legally. Recent revelations about a small team of doctors who treated many victims of Jeffrey Epstein are escalating concerns that not every request for treatment, including those for necessary treatment, should be managed similarly.

The Epstein Files Are Calling Physicians’ Choices into Question

As recently reported by the New York Times, a number of doctors allegedly treated Epstein as if he had the legal authority to review the private health information of and/or make medical decisions about his victims, some of whom may have been minors at the time. One physician was photographed sewing up a victim’s head wound as she lay on Epstein’s dining room table. One allegedly sent victims to other doctors for STD treatment, seemingly in order to minimize the risk of their connection to Epstein leaking to public health officials. Many accepted lavish gifts, research funding, and inflated payments in exchange for what they provided Epstein and his victims, which has elevated concerns that ethical lines were crossed in furtherance of these arrangements.

The complexity of both the human body and the forces that influence its functioning is staggering. As a result, no patient’s situation is ever truly straightforward. It is possible that the doctors who treated Epstein and his victims were trying to do their best for their patients, as they were managing questionable circumstances as effectively as possible. It is, therefore, important to avoid rushing to judgment of individual medical professionals named in the Epstein files until they’ve been permitted space and time to present a defense of their actions.
