The Kansas legislature is working to remedy the State Board of Nursing’s disproportionate approach to disciplinary actions. Before the passage of KS HB 2528, nurses who made small errors, like failing to renew their license in time or filling out a form incorrectly, received the same discipline as nurses guilty of far more serious violations, including sexual misconduct. HB 2528 changes that.

Significantly, the new law also voids all disciplinary actions for “nonpractice violations” handed down by the Board since 2005. And a related proposal in the budget making its way through the legislature allocates half a million dollars to pay claims by nurses who were harmed financially by those now-invalidated actions.

What KS HB 2528 Does for Nurses

In addition to voiding disciplinary actions for violations unrelated to patient care or clinical practice, HB 2528 also:

  • Narrows the definition of “unprofessional conduct” in a way that keeps the focus on patient care and safety
  • Allows for late license renewals
  • Prevents the Board from retaliating against nurses who file complaints about its actions
  • Allows nurses to challenge designations of “practice-related” conduct

These steps are good for nurses who face Board discipline now and in the future. For them, the state legislature has ensured that the grounds for discipline will be far narrower than they were in the past. Administrative mistakes and problematic behavior that have no bearing on clinical practice will no longer be eligible for disciplinary action.
